Terms of Service
DRAFT. NOT YET IN EFFECT. Must be reviewed by a qualified attorney before launch. Bracketed items like [COMPANY LEGAL NAME] must be filled in. This draft was prepared as a starting point and is not legal advice.
These Terms of Service ("Terms") are an agreement between you and [COMPANY LEGAL NAME], [ENTITY TYPE AND STATE] ("Amenflow", "we", "us"), and they cover your use of amenflow.com and the Amenflow app (the "Service"). By creating an account or using the Service, you agree to these Terms. If you're using Amenflow for a church or other organization, you confirm that you're authorized to accept these Terms for it, and "you" includes that organization.
1. What Amenflow does
Amenflow takes a sermon you provide (an audio or video recording, a podcast episode you choose from your own feed, or a manuscript) and produces draft ministry content from it, such as a transcript, summary, small group guide, newsletter, social captions, short captioned clips, devotional, kids' lesson and translations. Amenflow helps you share a sermon. It does not write sermons.
2. Your account
- You must be at least 18 years old and give accurate information.
- Keep your password secure. You're responsible for activity under your account. Tell us promptly at [SUPPORT EMAIL] if you suspect unauthorized use.
- One person or organization per account unless your plan says otherwise.
3. Your content
- You own your content. "Your content" means everything you upload (recordings, documents, feeds) and everything the Service generates for you from it ("outputs").
- You give us a limited license to host, copy, process, transcribe, translate, and transform your content only as needed to provide, secure and support the Service for you. We don't use your content to advertise, we don't sell it, and we don't publish it. We don't use it to train AI models. Your content is processed by our infrastructure and AI providers (currently Cloudflare Workers AI, whose terms say it doesn't use customer content to train models) only to provide the Service. [RE-CHECK IF YOU CHANGE AI PROVIDERS.]
- You confirm you have the rights to the material you upload, including any music, readings, or third-party content in a recording, and the permission of the speaker where needed.
- Review before you share. Outputs are drafts produced by automated tools, including AI language models. They can contain mistakes, misquotes, wrong Scripture references, or theology you wouldn't endorse. You're responsible for reviewing outputs before you publish, send, or teach them.
- Deletion. You can delete a sermon (its recording, transcript, clips and outputs) or your whole account at any time in the app. See the Privacy Policy for backup timing.
4. Acceptable use
Don't use the Service to: break the law or infringe others' rights; upload content you don't have rights to; upload malware or try to break, overload, scrape, or reverse-engineer the Service; get around usage limits or security; or harass, defame, or harm anyone. We may suspend or remove content or accounts that violate these Terms.
5. Plans, trials and payment
- Free trial: 3 sermons in total, with every feature included and no card required.
- Paid plans: Starter, Standard and Pro are billed monthly in advance in US dollars, at the prices shown on our pricing page when you subscribe. Each plan includes a set number of sermons per rolling 30-day period. Unused sermons don't roll over.
- Payment processing: Payments are handled by Stripe. We don't receive or store full card numbers. You authorize recurring charges until you cancel.
- Cancellation: Cancel anytime from Plan & billing. Your plan stays active until the end of the current billing period. [DECIDE AND STATE YOUR REFUND POLICY, e.g. "We don't provide refunds for partial months, except where required by law."]
- Price changes: We'll give you at least 30 days' notice by email before a price change applies to your subscription.
- Taxes: Prices exclude taxes unless stated. You're responsible for applicable taxes. [CONFIRM SALES TAX TREATMENT WITH AN ACCOUNTANT.]
6. Features marked "coming soon"
Features marked "coming soon" aren't available yet, and we don't promise when, or whether, they'll ship. Please don't buy a plan for a feature that isn't live.
7. Third-party services
The Service relies on providers such as hosting, payment processing, email delivery, and (if enabled) AI model providers. See the Privacy Policy for the current list. Your use of linked third-party sites (for example, Bible Gateway links) is governed by their terms.
8. Availability and changes
We work to keep the Service available and your content safe, but the Service is provided "as is" and may sometimes be interrupted. We may change or discontinue features. If we discontinue the Service entirely, we'll give you at least 30 days' notice so you can download your content.
9. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, AMENFLOW WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM (OR $50 IF YOU HAVEN'T PAID US). [ATTORNEY TO REVIEW.]
11. Indemnity
You agree to defend and indemnify Amenflow against claims arising from content you upload or your violation of these Terms. [ATTORNEY TO REVIEW SCOPE.]
12. Termination
You can stop using the Service and delete your account at any time. We may suspend or end your access if you materially breach these Terms, if we're required to by law, or if your account poses a security risk. Where reasonable, we'll notify you first and give you a chance to download your content.
13. Governing law and disputes
These Terms are governed by the laws of [STATE], excluding conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in [COUNTY, STATE]. [ATTORNEY: CONSIDER AN INFORMAL-RESOLUTION STEP OR ARBITRATION.]
14. Changes to these Terms
We may update these Terms. If a change is material, we'll email account owners at least 30 days before it takes effect. Continuing to use the Service after that date means you accept the updated Terms.
